1. This Penalty Cases arises out of Complaint No. 24/SIC/2012 where order was passed on 05/07/2012 holding that

“The Complaint is allowed. No intervention of this Commission is required as information is furnished”.

“Issue notice Section 20(1) of the Right to Information Act, 2005 to the Opponent/PIO to show cause why penal action not be taken against him for causing delay in furnishing the information”.

2. Accordingly Notice was issued fixing the first hearing on 21/8/2012. However, case could not be heard as the post SCIC remained vacant and hearing was resumed only in November 2013.

PIO has filed he say on 21/5/2014. He states that the RTI Appeal was received on 30/12/2011. Reply was given on 02/02/2012. Thus there is a minor delay of 3-4 days. He submitted that both PIO himself and APIO were holding double charges. Further, they alongwith majority of staff was given Election Duty thus there was no deliberate or Malafide intension. He prays for condoling the small delay.

The Complaint has remained the continuously absent on last two occasions, hence it can be presumed that since he has received the information, he has no more interest in the matter.

Hence Penalty Case is dismissed. Order declared Open Court. Parties to be informed.
