1) This Complaint is filed on 12/02/2013, and it arises out of original RTI application dated 09/01/2013 made to the PIO of Civil Registrar cum Sub Registrar of Salcete at Margao.

2) RTI application seeks a 3rd party information that refers to Certificate No. 575/2000 dated 12/5/2000 in respect of Mariano Piedade Fernandes and Roshan Shrikrishna Ajgaonkar, and asked for certified copy of each and every document filed by them. The questionnaire is as below –
A) a) Provide certified copy of each and every document filed by Mariano Piedade Fernandes that led your office to issue said certificate No. 575/2000 dated 12/5/2000.
b) Provide certified copy of each and every document filed by Roshan Shrikrishna Ajgaonkar that led your office to issue said certificate No. 575/2000 dated 12-5-2000.

c) Provide certified copy of the marriage certificate of Mariano Piedade Fernandes and Roshan Shrikrishna Ajgaonkar registered related to the certificate No. 575/2000 dated 12-5-2000.

B) The PIO has filed a reply before SCIC on 30/05/2013 stating that –
the Complainant was specifically requested to contact the undersigned for any clarification/assistance. If the Complainant had approached the respondent, the matter would have been clear and the respondent would have got the enclosure and the requisite details. But the Complainant preferred to file the Complainant before verifying the actual facts”.

4) Earlier the PIO replied to complaint on 22/01/2013 informing that the number 575/2000 referred to in her application was apparently an outward number of some eligibility certificate but not a marriage registration number. Hence marriage certificate cannot be located in the absence of more specific details, the names of Bride and Groom, Date of Marriage, Date of Registration of Marriage.

5) Complaint was filed on 12/02/2013 without availing the remedy of first appeal. It simply states that complainant had enclosed the said certificate No. 575/2000. But does not give the information required by the PIO.

I have perused the said certificate and find that it simply declares that one Mariano Piedade Fernandes and Roshan S. Ajgaonkar are qualified to get married. Therefore it does not necessarily disclose the name of the Bride and Groom, Date of Marriage, Date of Registration in respect of which the Complainant is seeking information.

6) After receiving the notice of hearing from this office, the Complainant remained continuously absent since 30/04/2013. A final notice was also issued on 11/08/2014. But the Complainant had remained absent. I agree with the PIO that copy of Marriage Certificate cannot be given until the details as asked by the PIO, are given by the complainant. As the Complainant is not persued, there is reason to

presume that complainant has lost interest. Moreover, any 3rd party information cannot be given without informing the third party. Hence I pass following order.

Complaint is dismissed. I don’t see any need for pursuing any penalty, the prayer in that respect is rejected. Order declared in Open Court. Parties may be informed .
