1) This Complaint arises on the issue of non compliance of the order of the SCIC in original Complaint No. 178/SCIC/2011 dated 02/12/2011. This order was passed by the then SCIC as below:-
The Complaint is allowed. The Opponent No. 1 is hereby directed to furnish the information, in proper form, to the Complainant as sought by her, vide her application dated 28/07/2011, within 20 days from the date of receipt of this order”.
2) It is seen that in compliance with the above order the then PIO has filed the compliance report on 22/05/2011 which inter alia gives following information ( he also informs the Complainant).

  1. No final Certificate was issued by the Department of Ophthalmology. However the matter was referred to the Department, later for opinion and the Xerox copy of the same is enclosed.

After the then SCIC retired on July 2012, the case has been adjourned from time to time but no hearing could take place till the joining of present SCIC in October 2013. Since the Complainant continuously remained absent a last chance notice was issued on 25/06/2014 and the Complainant was still absent.

At this stage it is necessary to note the original RTI application which states “on 29/05/2011 I was examined at Goa Medical College Hospital, Bambolim, casualty section and my M.L.C. case number is 4042. I was referred from Primary Health Centre Madkai as a case of Physical assault; and was suffering from injuries to eye and head. Subsequently, I was treated at Ophthalmology Department, and Neurosurgery Department from 29/05/2011 to 20/06/2011”.

During this period of more than 21 days I was constantly suffering from giddiness and double vision. As a result of this severe disabling injury, I was not able to do my routine work. It is requested to provide me the following information under Right to Information Act 2005.
  1. The type of injury sustained by me.
  2. Number of injuries sustained by me.
  3. Nature of injury (whether simple or Grievous hurt).

I have perused the information supplied to the Complainant on 2/05/2012 as well as another reply filed by present PIO Smt. Amonkar on 20/08/2014. The RTI question itself asks only about the hurt and not about subsequent condition of giddiness etc.

Looking at the two replies of PIO as well as the original RTI application I find that nothing remains in this Complaint hence the Complaint deserves dismissal.
