1) This complaint arises out of original RTI application dated 30/07/2012 made to PIO and Mamlatdar of Ponda Taluka. It is claim of the complainant that the PIO has given false and incomplete information. He has not filed reply of PIO along with his complaint memo, but merely states that information pertaining to question No. 7 has not been replied. He has not availed the remedy of first appeal.

2) Notices were issued fixing hearing w.e.f 05/11/2012. The Complainant has remain absent from 22/08/2013 onward till date. The present PIO submits that the then PIO has already given a reply on 29/08/2012 regarding point 7.

3) Question at point 7 is

“ List of mutation applications not registered or no notice were issued, which were filed in the year 2008, 2009, 2010 and 2011 and 2012”.

And the reply of the PIO states

“only such information can be supplied which already exists and is held by public authority or held under the control of the public authority. The public information officer is not supposed to create the information or to interpret information or to solve the problem raised by the applicants.”

4) I agree entirely with the PIO. As a courtesy to a common citizen who is not

always very knowledgeable about government systems, the PIO could have mentioned that there is no such concept as not registering mutation application or

keeping a separate list of mutation applications not registered. However since it is so, I agree with the PIO that his reply is not incomplete.

Complaint is dismissed as lacking merit. Order declared in Open Court. Inform the parties.
