This second appeal arises out of the RTI application dated 19/07/2011, made to PIO/S.P (N) Porvorim, Goa, regarding details of F.I.R no.281/09 registered by the Mapusa Police Station

When the second appeal came up for the hearing it was submitted by the appellant on 27/11/2014 that she had asked for case dairy in Criminal case no. 281/2009. The same was furnished to her today by Advocate A.Narvekar for PIO.

Thus this aspect finish the issue of supply of information what remain now is the prayer clause of the second appeal requesting for a penalty to the PIO for delay in reply.

On the last date of hearing on 09/01/2015 the appellant filed a separate application for issuing penalty to the PIO u/s 20(1). However, penalty cannot be imposed without an opportunity given to the PIO to explain his stand. Accordingly the Registry is instructed to start a new penalty case for proceeding u/s 20(1) and issue notice to the PIO.

The Second Appeal is closed as partly allowed. Separate penalty notice to be issue to PIO. Order declared in Open Court. Parties to be informed.
