This second appeal filed on 18/03/2010. It arises out of RTI application dated 09/10/2009 made to PIO/ Dy. Director, Chief Elect. Engineer, Vidyut Bhavan Panaji, Goa, asking information about Shri. S.T. Bangui, the third party, who had objected and hence the information was not given.

When the matter came up for hearing on 29/04/2014, the appellant filed a letter to withdraw the case stating that “the appellant has not been furnished with information sought in the RTI application till date and the matter has been prolonged unnecessary causing great inconvenience for him. Hence wishes to withdraw the present appeal. The same may be kindly allowed.”

In view of above, the second appeal is dismissed as withdrawn.

Order declared in Open Court. Inform the Parties.

This second appeal arises out of the RTI application dated 19/07/2011, made to PIO/S.P (N) Porvorim, Goa, regarding details of F.I.R no.281/09 registered by the Mapusa Police Station

When the second appeal came up for the hearing it was submitted by the appellant on 27/11/2014 that she had asked for case dairy in Criminal case no. 281/2009. The same was furnished to her today by Advocate A.Narvekar for PIO.

Thus this aspect finish the issue of supply of information what remain now is the prayer clause of the second appeal requesting for a penalty to the PIO for delay in reply.

On the last date of hearing on 09/01/2015 the appellant filed a separate application for issuing penalty to the PIO u/s 20(1). However, penalty cannot be imposed without an opportunity given to the PIO to explain his stand. Accordingly the Registry is instructed to start a new penalty case for proceeding u/s 20(1) and issue notice to the PIO.
