O R D E R (ORAL)

This Appeal if filed on 28/04/2012 by the Appellant who is not highly educated. She is mother of two daughter Ayesha Pinto and Ailda Pinto and informs me that her husband Mr. Pinto lives separate but without divorce. He works as a peon in St. Mary Convent High School and the daughters have studied in St. Thomas Girls High School during the period of 2002-2011. Both schools are under same management. The daughters were entitled to certain scholarships / reimbursements towards their education on the ground of economic condition of the parent. The school authority of St. Thomas school paid to the father whose name appeared in the school register, as the guardian of the two girls. He received the money from St. Thomas Girls High School but kept it for himself. It is the case of the appellant that though the daughters are staying with her, the father has not passed on the said money to them but has eaten it away.

That being the background, the appellant filed RTI applications on 09/03/2012 and 11/5/2012 to the PIO of the St. Mary Convent High School Mapusa asking for the following,
claim made to collect tuition fees in respect if my daughters i) Kum. Ayesha Pinto and ii) Kum. Ailda Pinto students of Saint Thomas Girls High School, Aldona for the period w.e.f. January 2002 to November 2011”.

As no information was received she has filed the First Appeal before the FAA namely OSD (Legal) Directorate of Education, Govt. of Goa, Porvorim which was returned to her on the ground that the copy of original RTI application was not enclosed. Hence she filed this 2nd Appeal in which she has made FAA the Respondent no 2.

On one date of hearing namely on 02/01/2014 when the FAA was also present, it was explained to Appellant that all the information requested by her in respect of actual payment of Scholarship or tuition fees etc would be available not with the St, Mary Convent High School where her husband is working, but she should get the same information from St. Thomas Girls High School where her both daughters have studied. The FAA who is the OSD and legal consultant with Directorate of Education undertook to advise the management of St. Thomas Girls High School to provide the information.

The Appellant has now received the information from St. Thomas Girls High School as well as Auxilium Primary School where the two daughters had studied during the period of 2002-2006. The document shows that on
most occasions, money was received by father but on few occasions, money was received by her, signing as mother.

In view of this it is clear that the Appellant has now received at least part information from the two schools where her both the daughters have actually studied. If she needs more information on the question of who has actually collected the Scholarship money (the father or mother), along with signature of recipient etc, then she has to ask a specific question mentioning the proper period to the school authority. If the money is received by the father (Shri. Seby Pinto) then she has to make an application along with request from both the daughters to the authority of St. Mary Convent High School to recover the same money from her husband (Shri. Seby Pinto), and pay it to her daughters. The St. Mary School Authorities will have to act as per law and proper procedure.

This Commission has nothing to intervene further. The appeal is dismissed with above observation. Order declared in Open Court. Inform the parties.
